Financial Disclosure
Overview
Financial disclosure department was founded in Ministry of Justice in accordance with financial disclosure provisions of Law No. (54) of 2006 issued on 01/11/2006, which is one of the National Integrity laws that are approved and entered into force by government.
In accordance with such law, Supreme Court of Justice Judge/ Dr. Nazim Arif is designated as Head of Financial Disclosure Department under the honorable Judicial Council resolution No. (137) of 2006, as of 18/12/2006. Separate division has been allocated for the department which has been provided with the necessary administrative cadre.
Financial Disclosure Department is deemed to be among the relevant departments for combating corruption, whose law represents means of protection for each person holding a high-level position and protection for government at the same time due to providing a mechanism for identifying disputes, or current or potential conflict between the responsibilities, interests and private activities of the incumbent, which enable the incumbent and the government to take the appropriate protection to face such this dispute.
The law also aims at preventing illicit wealth as a result of abusing designation or capacity by senior government officials, including all movables or immovables, and any benefit or right of benefit, and any increase for the funds of such concerned person, his wife or his minor children, where such increase does not commensurate with funds thereof, and such person was unable to prove legitimate source of such increase.
In the framework of development and modernization pursued by the government on enforceable legislations, Graft Law No. (21) of 2014 was issued. Such new law includes an expansion of the department’s officials in charge of publicizing financial disclosure, an amendment to some rules contained in the Financial Disclosure Law No. (54) of 2006 regarding periods and penalties for violating the provisions of the mentioned law, and maintaining the designation, powers, functions and organizational structure of the Financial Disclosure Department.
Prime Minister and Ministers, President and members of the Senate, Speaker and members of the Parliament, President and members of the Constitutional Court, judges, central bank governor and deputies thereof, chairman of the Royal Diwan and the Secretary General and the Minister of Royal Palace, advisers of His Majesty the King and advisers in the Royal Diwan, heads of independent bodies, authorities and members of boards thereof, chairmen of commissioners and members thereof, heads of official public institutions and public civil, military and security institutions, managers thereof, and board members thereof; if any; presidents of official universities, ambassadors and staff of the upper class and those persons of same rank and/or salary in government departments, public official institutions and public institutions, Mayor of Amman, and members of the GAM Greater Amman Municipality and heads of municipal councils and members of the municipalities from the first and second categories according to municipal law, heads of the committees of general central tenders and private civil, military and security tenders committees, procurement in governmental departments and in public and official institutions, public institutions, municipalities and members of any thereof, representatives of the government and social insurance in boards and managerial bodies in companies in which the government and social insurance have contribution, heads and board members, managerial bodies or any general manager companies and institutions wholly owned by the government or social insurance or public official institutions or public institutions, heads of professional and labor unions, heads and members of sports, labor, charitable and cooperative federations, heads and secretaries general of political parties; shall be subject to the provisions of Graft Law.
The acknowledgements of the financial disclosure are confidential documents, which may not be reviewed and the publication or content thereof is banned to be revealed. Thus, forms of financial disclosure were printed, envelopes with special specifications were prepared to save such acknowledgments. Additionally, a room was equipped with the necessary security precautions with steel fire-proof safes that save financial disclosure acknowledgments therein.
